Hurricane Ida Insurance Claims

Short answer: most Hurricane Ida claims are past the 24-month minimum deadline to sue, which ran out on August 29, 2023, but some policies allow longer, so an Ida claim still in dispute is worth checking against your policy.

Hurricane Ida made landfall near Port Fourchon on August 29, 2021, as a Category 4 hurricane with winds near 150 mph (NHC report). Surge reached 9 to 14 feet in east-bank Plaquemines Parish and 6 to 12 feet in Jefferson and Lafourche, overtopping local levees. Nearly every structure in coastal Lafourche and Jefferson, including Grand Isle, was damaged. Wind damage reached across greater New Orleans and the river parishes.

Is it too late for an Ida claim?

It depends on your policy. Louisiana law does not allow a homeowners policy, or most other property policies, to give you less than 24 months from the loss to sue (La. R.S. 22:868(B)), and for Ida that minimum ran out on August 29, 2023. If your policy’s “suit against us” clause gives you longer, you may still have time. If you think you still have a claim, call and we’ll check your dates.

Ida claims and the 2024 law changes

When Ida hit, La. R.S. 22:1973 required payment within 60 days of satisfactory proof of loss. It allowed penalties up to twice the damages caused by the insurer’s breach, or $5,000. The Legislature repealed that statute effective July 1, 2024. For claims that arose before the repeal, the old law generally still applies.
